Notice of Commencement

A Notice of Commencement is publicly filed in county records to signify that a construction project is beginning and protects material providers and laborers from non-payment. 

This document is prepared by the Closing Agent upon request and is required when the loan is: 

  • For construction purpose
  • For improvements/renovations to an existing structure
  • For development purpose
     

Processing a Notice of Commencement (NOC)

The NOC MUST be recorded:

  • In the county where the project is located
  • PRIOR to beginning construction
  • AFTER our mortgage is recorded

 

Upload document to https://ep.erecording.com/Login.aspx 

  • If the County is not available for eRecording:
    1. Record executed original in the Public Records in the County where the collateral property is located.
    2. Issue a check made payable to Clerk of Court, _______________ County.

Provide a certified copy to the contractor and post a copy at the project site 

 
 

 

Once completed, the Notice of Commencement is uploaded to Synergy (consumer purpose) or Abrigo (business purpose). If all documents are “wet signed”, send to loan servicing in the designated bag.
