A client unable to sign their full name, due to being illiterate or having a physical disability, may request to sign account documents using a mark. The mark is typically an 'X' and is used in place of a full signature.
Capital City Bank (CCB) requires the completion of a Signature by Mark Affidavit Signature Card. The Signature by Mark Affidavit Signature Card document must be completed and included with any new or revised account documents containing a 'mark'.
For Safe Deposit Box Contracts, CCB requires the completion of a Signature by Mark Acknowledgement Affidavit for Safe Deposit Box to be completed and included with any new/revised contract containing a 'mark'.
Complete the document in the presence of the client, notary and 2 disinterested persons as witnesses.
Follow the procedures below when capturing a client's 'mark' on applicable documents:
- Obtain the client signature (Mark) on the account document.
- The signing of the account document must be witnessed by 2 disinterested persons.
- The notary prints the first name of the client making the 'mark' at the beginning of the designated signature line and the last name at the end of the designated signature line.
- The notary prints the words "his (or her) mark" below the clients signature mark.
- Both witnesses must sign under the account owners' signature on the signature card with the designation of witness. (For example: Witness: Signature of witness).
