Mortgage (FL/AL) / Security Deed (GA)

A Mortgage (FL/AL) / Security Deed (GA) places the bank's lien on the described real estate and notifies the public of the lien. 

This document is included with the loan package provided by Loan Doc Prep and is required when the loan is secured by real estate.

 

Record the executed original in the Public Records of the State and County where the collateral property is located. See eRecording Step by Step for additional details.

Alabama

Issue a check made payable to Clerk of Court, _______________ County.
 

Check is to include the following fees:

  • Mortgage Tax
    • $0.15 per $100 (on rounded loan amount).
    • Round loan amount UP to the nearest $100 (for example: $4,555 rounded to $4,600).  
    • Rounded loan amount X .0015 (for example: $4,600 X .0015 = $6.90)
  • Recording Fees
    • $3.00 per page
    • Plus $6.00 Processing Fees
    • Plus $1.00 for each additional debtor name over 2

Issue a check made payable to Clerk of Court, _______________ County.

Check is to include the following fees:

  • Doc Stamps  
    • $0.35 per $100 (on rounded loan amount).
    • Round loan amount UP to the nearest $100 (for example: $4,555 rounded to $4,600).  
    • Rounded loan amount X .0035
      (for example: $4,600 X .0035 = $16.10)
  • Intangible Tax 
    • $0.20 per $100 (on exact loan amount).
      Loan amount X.0020 (Ex: $4,555 X.002=$9.11)
  • Recording Fees
    • $10 first page
    • Plus $8.50 for each additional page
    • Plus $1.00 for each additional name over 4 (Note: Capital City Bank is considered a name)

If County is not available for eRecording:

Issue a check made payable to _____________ County Clerk of Superior Court. 

Check is to include the following fees:

  • Intangible Tax  
    • 1.50 per $500 when loan term is 36 months or more
      • Round loan amount UP to the nearest $500 (Ex: $4,555 rounded to $5,000).  
      • Rounded loan amount X 1.5 /500 (Ex: $5,000 X 1.5/500=$15.00)
  • Georgia Residential Mortgage Act Tax (GRMA)  
    • $10.00 when loan is to one or more individuals, and
    • secured by residential real estate
  • Recording Fees
    • $25.00
 
 

Consequences

If the Mortgage/Security Deed is incomplete or not recorded, or recorded in the incorrect county, you will not have a security interest in the real estate and the loan may be considered unsecured.

 
 

 

Completed documentation must contain the following information: 

  • Name of property owner(s)
  • Marital status of property owner (if individual(s))
  • If homestead property, spouse must sign (FL/AL)
  • Address of property owner
  • Amount of lien
  • Legal Description of property 
  • Property Owners signature

 

We MUST have the original Mortgage/Security Deed signed with a pen (wet signed).  If the loan package was sent to you using IMM eSign, PRINT the Mortgage/Security Deed and have the client sign.  

  • eSign-Web:  Real Estate secured loans cannot be delivered via eSign-Web.
  • Submit/send the ORIGINAL SIGNED Mortgage/Security Deed to the County where the collateral is located for recording.
  • The ORIGINAL SIGNED Mortgage/Security Deed must be sent to Loan Servicing in the designated bag.  You may upload a signed copy to Synergy (Consumer Purpose) or Abrigo (Business Purpose)
