
The Collections and Litigation department is responsible for the collection of all past due loans for the Bank, assisting loan officers in handling collection of their loans, and, when necessary, filing a lawsuit with the court to collect. They also help associates with questions about past due loans.
The department defines a past due loan as a loan that is 10 days beyond the due date. In coordination with lenders, collection associates call clients with a loan that is 30 days or more past due in an effort to bring the loan to current status. If it is not possible to bring the loan to current status, the department assists clients with workouts on problem loans.
A workout is a mutual agreement negotiated by the Bank and the delinquent borrower to put the loan repayment back on track. It generally provides some measure of relief to the borrower and often includes rescheduling the loan over a longer payback period to effect a smaller installment amount.
A charged-off loan is a loan that has been written off as a loss due to non-payment of the balance. Litigation is responsible for contacting all clients that have a charged-off loan in an attempt to recover monies for the Bank. While a charge-off is considered to be "written off as uncollectible" by the Bank, the debt is still legally valid. Depending on numerous variables, including the amount of the charge-off, there is a possibility of a lawsuit or arbitration.
The associates of litigations are responsible for filing these claims with the court. Depending on limits set by state statutes, litigation associates will either appear in court on behalf of the Bank or will work with a law firm to file a claim on behalf of Capital City Bank.
All bankruptcies, repossessions, sales of repossessions, and recoveries are also handled by the Collections and Litigations Department.
