Special Provision for Alabama and Georgia Intestate Depositors

There are provisions for the disposition of funds when the depositor dies without a will and had $5000 or less on deposit in a bank in Alabama or $15,000 or less on deposit in a bank in Georgia.  

When you receive an in-person request for the payment of account balances for intestate depositors, do the following:

  1. Determine if the following conditions are met for the CCB depositor:
    • Died without a will 
    • Had one of the following:
      • $5,000 or less on deposit in a bank in Alabama 
      • $15,000 or less on deposit in a bank in Georgia
  2. Obtain the corresponding form: 
  3. Fill in the form and have it notarized. 
  4. Change the depositor status to deceased.
  5. Check to see if the funds recently deposited are subject to reclamation. 
  6. In the case of multiple beneficiaries, do the following:
    • Divide the funds equally. 
    • If only one beneficiary is present, then distribute his/her portion to him/her. The account remains open. The other beneficiaries must come to receive their portions.  
  7. In the case of one beneficiary, do the following:
    • Distribute the funds to him/her.
    • Close the account.
